Our platform is dedicated to advertising opportunities for subject-to real estate transactions (“Subto”), where buyers can take over sellers’ loan payments and transfer ownership by mutual consent.

Brokerage Services

We are a licensed real estate brokerage and operate in compliance with the Department of Real Estate (DRE) regulations in California and, where applicable, partner with local brokers in other states in accordance with regional DRE regulations. Our role is to facilitate the brokerage of Subto transactions; we do not act as legal or tax advisors.

Transaction Risks and Responsibilities

Participants in Subto transactions should be aware of potential risks, including but not limited to the Due on Sale clause, which could lead to the acceleration of the loan by the lender. Insurance and warranty claims, as well as the physical condition of the property, are the responsibility of the buyer unless otherwise agreed in writing. Hardin Realty & Property Management DBA Subto Shop is not liable for any losses, damages, or claims that may arise from these transactions.

All properties listed on Subtoshop.com are offered “as-is” with no warranties, express or implied, and all sales are considered final unless a written agreement between the buyer and seller states otherwise. It is the buyer’s responsibility to conduct due diligence on the property’s condition, legal standing, and any other relevant factors.

Exclusivity and Fees

By using Subtoshop.com, users agree to conduct all property transactions facilitated by our platform exclusively through Subto Shop or Hardin Realty & Property Management. Attempts to circumvent our platform by engaging in off-site transactions related to properties listed on Subtoshop.com may result in the user being responsible for a standard fee of 2.5% of the final sales price, capped at $10,000 USD.

Indemnification

By using Subtoshop.com, you agree to indemnify and hold harmless Hardin Realty & Property Management DBA Subto Shop, its officers, directors, employees, and agents from and against any claims, damages, costs, and expenses, including attorneys’ fees, arising from or related to your use of the website or your violation of these terms.

Modification of Terms

We reserve the right to modify these legal disclaimers and terms of use at any time without prior notice. Your continued use of Subtoshop.com after any such changes constitutes your acceptance of the new terms.

Governing Law

These terms and your use of Subtoshop.com are governed by the laws of the State of California, without regard to its conflict of laws principles.
