If you do not agree with any part of these terms, you must not use this website.
Nature of Service
Subtoshop.com is a platform designed to facilitate subject-to real estate transactions (“Subto”), where a buyer takes over the payments of the seller’s existing loan. We are a licensed real estate brokerage, not a financial advisor, law firm, or investment company. The information and services provided on our website are intended for informational purposes only and should not be construed as legal, tax, or investment advice.
Consultation with Professionals
We strongly advise all users of Subtoshop.com to seek independent legal and financial counsel before participating in any Subto transaction. Real estate investments carry inherent risks, and it is crucial to fully understand these risks and the legal implications of any transaction.
Earnest Money Deposits
Buyers are required to submit an earnest money deposit within 3 days of an accepted offer to demonstrate their commitment to the transaction. Failure to comply with this requirement may result in the cancellation of the offer and potential forfeiture of any deposit made.
Risk Acknowledgement
All users of Subtoshop.com acknowledge that real estate investments are made at their own risk. Hardin Realty & Property Management DBA Subto Shop shall not be liable for any losses, damages, or claims arising from transactions facilitated through our platform.
Wholesalers and Agents
We welcome both wholesalers and licensed real estate agents to submit property deals to Subtoshop.com. Wholesalers are individuals or entities that identify and negotiate real estate opportunities, subsequently assigning their contractual rights to an end-buyer for a fee. Agents are licensed professionals who may represent sellers in these transactions. All deals submitted through our site are subject to our review and approval, and compensation will be provided at the point of sale in accordance with agreed-upon terms. Hardin Realty & Property Management DBA Subto Shop makes no representation or warranty regarding the veracity or accuracy of any information found on our site, and we strongly recommend that end buyers conduct their own thorough due diligence and consult a local real estate attorney before transacting.
Exclusivity and Fees
Wholesalers and real estate professionals may post properties and “Subto” opportunities for sale on our site, with Admin approval. By doing so, these parties agree that all information is accurate and up to date to the best of their knowledge. You also understand and agree that Hardin Realty & Property Management DBA Subto Shop shall be entitled to 20% of the “Wholesale Fee” or “Assignment Fee,” with a minimum fee of $1,000 USD and a maximum of $5,000 USD per transaction. Hardin Realty & Property Management DBA Subto Shop will submit an invoice through Escrow during the transaction and will be paid therefrom.
By using Subtoshop.com, users agree to conduct all property transactions facilitated by our platform exclusively through Subto Shop or Hardin Realty & Property Management. Attempts to circumvent our platform by engaging in off-site transactions related to properties listed on Subtoshop.com may result in the user being responsible for a standard fee of 2.5% of the final sales price, capped at $10,000 USD.
Modifications to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time without prior notice. Your continued use of Subtoshop.com after such modifications signifies your acceptance of the revised terms.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the state and federal courts located in Sacramento County, California.
